Terms and Conditions

These Terms and Conditions govern the use of this website and the contractual relationship between the customer and Eco de Certezas LDA, with registered office at Rua Branca Gonta Colaço 12 R/C Esquerdo, Tax Identification Number (NIPC) 518 484 629.

1. Scope

Eco de Certezas LDA is engaged in the import, sale, and rental of electric motorbikes, operating in the following models:

  • B2B (sales and rentals to businesses);

  • B2C (sales to individual consumers).

2. Orders and Payments

Orders become effective only upon payment confirmation and verification of all necessary information. Prices are shown in euros (€), including VAT, unless expressly stated otherwise.

3. Pre-Sales

In the case of pre-sales, delays may occur in relation to the initially estimated delivery date. In such situations, Eco de Certezas LDA undertakes to deliver within the maximum timeframes permitted under applicable Portuguese law and shall not be held responsible for delays caused by external factors.

4. Returns Policy

Eco de Certezas LDA does not accept returns, except in the following cases:

  • Exercise of the legal right of withdrawal (applicable only to final consumers, within 14 days of receipt, in accordance with Decree-Law No. 24/2014);

  • Defective or damaged products, provided they are reported within the legal timeframe;

  • Other circumstances required by law.

All returned products must be complete, unused, and in their original packaging.

5. Warranty

All products sold by the Company include the statutory warranty, in accordance with Decree-Law No. 84/2021, of 18 October. In B2B transactions, a separate contractual warranty may be agreed upon.

6. Rentals

Electric motorbike rentals are strictly for business clients and subject to a dedicated contract that sets out:

  • Conditions of use and duration;

  • Maintenance obligations;

  • Responsibilities and applicable penalties.

7. Liability

The Company shall not be held liable for indirect damages, loss of profits, or any damage resulting from the improper use of the products.

8. Amendments

Eco de Certezas LDA reserves the right to update these Terms and Conditions at any time without prior notice. The updated version will always be made available on the website with the respective revision date.

9. Governing Law and Jurisdiction

All contracts and transactions are governed by Portuguese law. In the event of a dispute and where no amicable resolution is reached, the competent court shall be that of the judicial district where Eco de Certezas LDA is headquartered, with express waiver of any other jurisdiction.
